IN CITY COUNCIL

TUESDAY OCTOBER 18, 2005

TIME 6:30PM

Roll call showed 8 present, 1 absent (C. Milinazzo).

Mayor A. Mercier presiding.

CITY CLERK

Minutes of October 11th for acceptance. In Council, Read, accepted and placed on file by motion of C.R. Mercier, seconded by C. Broderick. So voted.

CITY MANAGER

Order-60 Day Trial, Traffic Regulations, various locations. In Council, Read twice and adopted 8 yeas, 1 absent (C. Milinazzo). So voted.

C.R. Mercier then moved, seconded by C. Elliott “To Suspend the Rules”, for the purpose of presenting a Communication pursuant to Chapter 268A. So voted.

REPORTS

C. Elliott, Chairman of the Finance Sub/Committee said they had met jointly this evening with the Public Safety Sub/Committee to discuss the final report from the Law Enforcement Trust Fund. C. Elliott said the final result of the meeting is that all the recommendations since the draft report are being addressed or have been addressed.

  1. All accounting issues are being addressed or have been addressed.

  2. Disbursements are being tracked by the Auditor's Office and are meeting with the Treasurers Office on a monthly basis. Ms. Gendron an employee of the Police Department has narrowed the $35,000 discrepancy down to $5,200 to close the gap.

  3. The $46,744 in unsupported expenditure for overtime, we are still waiting for clarification. C. Elliott said there was a motion made by C. Donoghue to revisit this issue if necessary. So Voted.

C. Elliott said lastly was that this is a Special Fund and not a City Fund, and that all players must be on the same page. C. Elliott also said that Chief Davis is going to do a separate audit annually of this fund to keep things straight. Report then adopted as a report of progress on motion of C. Elliott, seconded by C. Donoghue.

PETITIONS

Conduit Location-Mass. Electric Co. requesting to place conduit in Church Street. In Council read and hearing ordered for 7PM on November 1, 2005. So voted.

Claims-The following claim was read and referred to the Law Department on motion of C.R. Mercier, seconded by C. Martin. So Voted.

Sandra Kraus, Lowell, MA-Property Damage.

MOTIONS

BY C. CAULFIELD, seconded by C.R. Mercier

“Request the city Manager have proper vote drawn to name the Instructional League Park in the Jack Bowers Complex in honor of Robert Vigeant”. In Council, Referred to the Board of Parks. So voted.

BY C. DONOGHUE, seconded by C.R. Mercier

“Request the City Manager report on the hours of operation and the procedures of the Animal Control Officers relative to the notification of owners when the city has taken possession of animals”. In Council, Referred to the City Manager. So voted.

BY C. DONOGHUE, seconded by C.R. Mercier

“Request the City Manager have the Election Commission provide a report on the polling places, training and procedures for the upcoming election”. In Council, Referred to the City Manager. So voted.

BY C. HOWE, seconded by C. Broderick

“Request the City Council Economic Development and Downtown Sub/Committee convene a meeting with the Representatives of the Mass Mills for the purpose of commencing and completing the rehabilitation of the Picker Building and the Boiler House that borders on the Merrimack River and the Concord Rivers and report their recommendations in two weeks”. In Council, Referred to the Economic Development and Downtown Sub/Committee. So voted.

“Request that prior to the City's acknowledgement of substantial completion of the Stoklosa School, that the Mayor convene a joint City Council/School Committee meeting to discuss the condition of the school building”. In Council, Referred to a joint meeting of the Stoklosa School Construction Ad/Hoc Sub/Committee and School Committee. So voted.

BY C. ELLIOTT, seconded by C. Caulfield

“Request the City Manager have the Police Chief address the traffic jams on Bridge Street and the VFW Highway”. In Council, Referred to the City Manager. So voted.

BY C. ELLIOTT, seconded by C. Howe

“Request the City Manager have the Law Department clarify it's opinion on the housing development at 5-7 Wright Street”. In Council, Referred to the City Manager. So voted.

C. Elliott then moved, seconded by C.R. Mercier “To Suspend the Rules”, to allow Kelly Bechard, 288 10th Street to speak relative to traffic problems on 10th Street. So voted.

At 8:05 PM, C. Howe moved, seconded by C. Broderick “To Adjourn”. So voted.
