Hearings
122 Western Avenue
A Public Hearing will be held to hear all interested persons relative to a Repetitive Petition application to the
Planning Board by BPV Lowell, LLC for the ability to construct 68 live/work artist units in an existing building
located in the Artist Overlay District at the above listed address. On January 14, 2008, the Lowell Zoning
Board of Appeals (ZBA) took an “unfavorable action” denying a special permit to construct 48 live/work units
and denying a parking variance. In order for the ZBA to consider the merits of this new application, the
Planning Board must consent that the new application contains specific and material changes from the first
application. The Planning Board will take this vote at the conclusion of the public hearing.

their proposed project at the addresses listed below. These are not public hearings.

information purposes only.

Business
117 Marginal Street
The Board will review a request by Brasi Development Corp. to accept a minor change to the Site Plan
approval for the university student housing project located at 117 Marginal Street. The project was
approved during Planning Board meeting schedule June 18, 2007 with ten (10) conditions. The
developer is proposing to develop the project in multiple phases over time rather than develop the
project entirely in a single phase. The Board will review and decide if the alteration warrants a minor
change and amendment to the existing Site Plan approval or if the project phasing constitutes a
substantial change and should proceed through a full hearing process.

1519-1527 Middlesex Street
The Board will Review a request by Kevin Decker, Property Manager for The Commons
Condominium located at 1541 Middlesex Street, on behalf of The Commons Condominium Trust in
order to determine the condition of Site Plan approval is being properly met. The condition in
question requires the applicant to use their best efforts to screen the building and mechanical
equipment on the roof of the building from the Condominium building. The Board will determine if
the applicant has satisfied the intent of the condition of approval.
