CALL TO ORDER
Louisa Varnum: Called the meeting to order at 7:00
ENFORCEMENT ORDER (continued from 12/16/09)
Peter Ngeth
409 Pawtucket Street
Lowell, MA 01852
Filling in Buffer Zone
Louisa Varnum: There were some piles of dirt, most of which came from the front of the house, placed in the buffer zone. We had a discussion where we informed you that this soil needed to be removed. We feel that much of it was spread around instead of being removed.
Peter Ngeth: I paid a contractor $1500.00 to have the soil removed.
Louisa Varnum: What date was that?
Peter Ngeth: The day after the meeting.
Louisa Varnum: After inspecting the backyard, we still saw remnants of glass and other materials in the soil. This would indicate that not enough of the soil was removed to bring the backyard to its original grade.
Peter Ngeth: I told the contractor to remove all of the dirt he had put back there. He came back two times.
Louisa Varnum: What about the stone and the steps in the backyard?
Peter Ngeth: They were there when I bought the house.
Nate Moore: Did the contractor tell you how many cubic yards they removed?
Peter Ngeth: They took a lot. Maybe 10 truck loads.
Louisa Varnum: When the snow melts, the commission will need to go back for another inspection. We will call your contractor to confirm the amount of soil removed and contact you if paperwork needs to be filed.

Repaving of an existing parking lot
Steve Eriksen: We are looking to replace the pavement on an existing property. The pavement is cracked and falling apart. It is in the flood plain. We will rip the pavement up, put 4”-6” of new pavement down and maintain the same elevations as before. The pavement that is taken up will be recycled. There is no other resource area near the project location.
Nate Moore: I thought when they were in here before; they had talked of some more paving.
Steve Eriksen: They are not increasing the amount of pavement. They are keeping the same amount. They don't have enough real estate to go anywhere else.
Louisa Varnum: I notice there's a gravel area on your plan that used to be trees and grass.
Steve Eriksen: That will stay the same. We do not plan to change that.
Louisa Varnum: It has been changed already. That area used to be brush and other plants. This is why we gave them an Enforcement Order previously.
Steve Eriksen: That has been a gravel area since I was hired to perform this work.
