Workers' Compensation Program
Responsibilities
The Workers' Compensation office oversees work-related injury claims. This office is committed to ensuring that all injured employees receive prompt medically appropriate treatment and if applicable, wage replacement according to the appropriate laws governing such matters.
Initiating Your Claim
The Law Department has engaged the services of a Third-Party Administrator, Guardian Claims Services, to handle the administration of workers compensation claims related to City employees. This means the City no longer handles the administration of workers comp claims internally.
Please refer to the following guidelines of required procedures when a member of your department is injured on the job:
- When an employee in your department reports an at-work injury to you, immediately fill out an injury report and send the same to Nellie Vieira, Assistant Workers Compensation/ Claims Agent (nvieira@lowellma.gov), as well as Shaun D'Ortona with Guardian Claims Services (sdortona@guardianclaimsservices.com). Kindly include in said emails the employee's name, employee ID number, and date of injury.
- If the employee is out more than five days (weekends/holidays included), please inform Nellie Vieira and Shaun D'Ortona on the fifth day of incapacitation.
- If the employee returns to work at any time, report the same to Nellie Vieira and Shaun D'Ortona the same day they return.
- All emails from Shaun D'Ortona, or any other representative of Guardian Claims Services to you must be responded to in a timely manner, in order to assist in meeting strict deadlines with the Department of Industrial Accidents (DIA).
